Peru, IN - Dayton Erickson, 23, of Peru, was arrested by the Peru Police Department on October 12, 2019, on a charge of Operating While Intoxicated and a Probation Hold.

According to a PPD Probable Cause Affidavit, PPD Officer Tyler Hagen was patrolling in the 200 block of S. Broadway Avenue at approximately 11:03 p.m. on Saturday, October 12th when central dispatch advised of a possible intoxicated driver traveling southbound on Broadway from Canal operating a red moped.

It was reported that the red moped was “all over the roadway and had at one point wrecked into a curb” according to Hagen’s report.

While en-route to the area, dispatch advised that the red moped was parked at Broadway Liquors on South Broadway Street.

As Officer Hagen arrived on the scene, he observed a male get on the red moped and drive northbound on North Broadway Street. He was able to get behind the moped and observe. As he followed the moped northbound on Broadway, he observed it to be making sharp, sudden motions back and forth.

According to his report, it appeared to Hagen “that the driver of the moped was having difficulty remaining balanced on the moped.”

The moped then turned east on to 6th and it then parked in a parking lot.

Officer Hagen stopped and approached the driver who was identified as twenty-three-year-old Dayton J. Erickson. During a consensual encounter, Officer Hagen informed Dayton of the reason for him speaking with him. Dayton advised that he wrecked the moped approximately 10 to 15 minutes prior and it was not “driving funny”.

Officer Hagen observed Dayton’s speech to be slow and slurred. It also appeared that his balance was unsteady as he got off the moped. Officer Hagen also noted that Dayton’s eyes were red and watery. There was an unopened case of Bud Light that was sitting on the floorboard of the moped.

When asked if he had been drinking, Dayton responded: “I have”. He continued by saying “if you breathalyze me, I would go to jail.”

While speaking to Dayton, Officer Hagen began to detect the odor of an alcoholic beverage coming from his person. Dayton also admitted to a previous OWI approximately three weeks ago.

Officer Hagen began to perform the Standardized Field Sobriety Tests on Dayton. Dayton failed all three tests given.

During the testing, Dayton advised that he “wished I (Officer Hagen) would PBT (portable breath test) him because he could pass this test with flying colors.”

After being read Indiana Implied Consent, Dayton refused a Portable Breath Test along with the certified chemical test.

He was then placed into handcuffs and put into the back of Hagen’s patrol vehicle.

Central dispatch then advised that Dayton’s driving status was suspended.

Dayton Erickson, 23 of Peru was transported to the Miami County Jail on charges of Operating While Intoxicated and Driving While Suspended. Upon arrival at the jail and checking his record, it was learned that Dayton had a guilty conviction for OWI on 10/01/19.

All criminal suspects are presumed innocent until proven guilty in a court of law.
