Peru, IN – A traffic stop conducted on Thursday, September 5, 2019, at approximately 7:09 p.m. resulted in the arrest of Robby Emery, 30 of Denver on a charge of Possession of Methamphetamine.
According to a Peru Police Department probable cause affidavit, Emery was a passenger in a Green in color SUV that was stopped after being observed near the intersection of Main and Lincoln Streets for following too close to the vehicle in front of it. The traffic stop was conducted by PPD officer Brok A. Westfall.
The driver’s name was redacted from the report by the Miami County Prosecutor’s Office. While speaking with the driver and Mr. Emery, Officer Westfall noted that Emery had labored breathing, shaky hands and appeared to be seating.
Officer Westfall issued the driver a warning for following too closely. While speaking with the driver a second time he realized he needed to issue her a no-trespass warning from a prior incident. He returned to his Police vehicle to complete the no-trespass warning. Upon his return, he asked the driver for permission to search the vehicle and the driver granted permission.
While searching the vehicle, Officer Westfall located a small crystal-like chunk sitting in the passenger seat where Emery had been seated. The chunk tested positive for methamphetamine and weighed approximately .1 gram.
Mr. Emery was then read his Miranda warning and advised that the item located was his.
Emery was then placed in the rear seat of Westfall’s police vehicle and transported to the Miami County Jail.
Robby Emery, 30 of Denver, IN faces a charge of Possession of Methamphetamine.
All criminal suspects are presumed innocent until proven guilty in a court of law.
