Peru, IN - PPD officers responded to a report of a domestic altercation in the 1000 block of Magnolia Drive on March 30, 2019, at approximately 8:28 p.m. the would end in the arrest of twenty-eight-year-old Joshua Azbell of Peru on charges of Operating While Intoxicated and Domestic Battery X2.

According to a probable cause affidavit filed by PPD Officer Westfall, Officers were advised while en-route that the male half of the domestic had left the residence in a light blue Chevy vehicle and was intoxicated.

Mr. Azbell was located near the intersection of Rosewood Drive and Cherry Lane with inside the vehicle with the engine still running and the lights on. Officer Westfall pulled in behind the vehicle and activated his emergency lights.

Officer Westfall then approached the vehicle and observed Mr. Azbell in the driver’s seat. Azbell told Officer Westfall that he had driven to that location which was just around the corner from his residence.

While speaking with Mr. Azbell, Officer Westfall could detect the odor of an alcoholic beverage coming from the vehicle. He also observed Mr. Azbell’s eyes to have a “glassy appearance.

When asked about the disturbance at his residence, Mr. Azbell denied anything physical had taken place.

Azbell was asked to step out of the vehicle. Once outside, Officer Westfall could continue to detect the odor of an alcoholic beverage coming from Mr. Azbell.

Azbell was then asked and consented to a series of Standardized Field Sobriety Tests. The results of these tests indicated that Mr. Azbell was under the influence of a substance.

Mr. Azbell refused to take a portable breath test and after being read Indiana Implied Consent, he also refused to talk a certified breath test. At this point, Mr. Azbell was placed under arrest for Operating While Intoxicated – Refusal.

PPD Sergeant Raber and Officer Westfall conducted an investigation at Azbell’s residence with a subject whose name was redacted by the report by the Miami County Prosecutor’s Office. This investigation resulted in two charges of Domestic Battery being filed against Mr. Azbell. The Department of Child Services was also contacted regarding this incident.

Joshua Azbell, 28, of Peru, was transported to the Miami County Jail to face charges of Operating While Intoxicated and Domestic Battery X2.

All criminal suspects are presumed innocent until proven guilty in a court of law.
