Miami County, IN – A Marion man who passed a State Trooper in the left lane while the Trooper was conducting a traffic stop, was arrested on charges of Operating While Intoxicated and Operator Never Licensed on Wednesday, February 6, 2019, at approximately 1:12 p.m.
According to a probable cause affidavit, Trooper Adam C. Moor was conducting a traffic stop with a vehicle on the right shoulder of Northbound US Route 31 near Mexico Road in his State Police vehicle with his emergency lights activated when a 2002 Pontiac passed him in the right lane at approximately 60 to 65 miles per hour causing his police vehicle to shake.
There were no other vehicles around the Pontiac and the driver failed to switch to the left lane when it was open.
Trooper Moor also noted that the vehicle registration on the Pontiac was possibly expired.
Moor quickly ended his current traffic stop and activated his siren to stop the Pontiac. He caught up to the Pontiac north of State Road 16. The vehicle pulled over onto the right shoulder of the roadway.
Upon approaching the passenger side of the vehicle, the driver stated he wanted to go to jail. When asked why he stated he didn’t have anywhere to go and wanted a place to stay. He further stated that he hoped that the Trooper Moor would stop him.
While speaking with Mr. Trudeau, Trooper Moor detected the odor of an alcoholic beverage. He also noted that Trudeau’s eyes were bloodshot and watery and that he was slurring his words.
The man was identified with a state identification card as Joseph J. Trudeau, 57 of Marion. He reported the car didn’t have a valid registration because he was gifted the car.
When asked how much he had to drink, Trudeau stated he had 10 shots of rum with his last drink being about an hour ago.
Trooper Steven Glass and Trooper Jesse Reason arrived to assist. Mr. Trudeau was patted down for weapons with none being found.
The license plate on the vehicle was expired on April 7, 2018, and was registered to a different person. Dispatch also advised that Trudeau only held an identification card and was suspended as of December 15, 2009, for failure to appear. There is no record of Mr. Trudeau being issued an operator’s license and he has a prior conviction for OWI in March of 2009.
Mr. Trudeau was given the standard field sobriety tests as well as a portable breath test with a result of .205 Br. A.C.
Trudeau was then placed into handcuffs and transported to the Miami County Jail for additional sobriety field tests as well as a certified breath test. At approximately 3:53 p.m., Trudeau proved a sample of .231 grams of alcohol per 210 liters of breath.
Joseph Trudeau, 57 of Marion, IN was then placed under arrest on charges of Operating While Intoxicated and Operator Never Licensed. He was also issued a warning for failing to change lanes for a stationary emergency vehicle and a citation for the expired license plate.
All criminal suspects are presumed innocent until proven guilty in a court of law.
