Peru, IN – A traffic stop on January 2, 2019, resulted in the arrest of a Pennville man on Charges of Obstruction of Justice, Possession of Marijuana, Possession of Heroin, Possession of Methamphetamine and Possession of Cocaine.
According to the probable cause affidavit, Officer Westfall saw a white passenger vehicle disregard a stop sign at 5th and Wabash streets at approximately 8:59 p.m. on January 2, 2019. It then continued eastbound, turning south onto Huntington Street from 5th Street.
Officer Westfall activated his emergency lights to stop the car as the suspect turned east into the alley behind the Peru Public Library and continued to travel eastbound at a slow rate of speed. As the vehicle continued to travel, Officer Westfall observed a back-seat passenger arching his body and moving around in the back-seat. He then saw the same passenger throw several items that appeared to be small plastic bags out the window of the vehicle.
The vehicle finally came to a stop in the alley. Officer Westfall exited his police vehicle with his gun drawn and advised Central Dispatch of his location. He then watched the occupants of the vehicle until additional officers arrived on scene to assist.
Upon the arrival of assistance, Officer Westfall was able to locate one small green plastic bag that contained a black folded up piece of paper, one plastic bag that contained a large amount of a white crystal substance, one small plastic bag that contained a white crystal substance, and one small plastic bag that contained a brownish/white powdery substance.
Upon returning to the vehicle, Officer Westfall had the back-seat passenger, identified as James Lee, 39, of Pennville, IN exit the vehicle. He was immediately placed into handcuffs.
A search of Mr. Lee would result in the location of a cigarette package with a hand-rolled cigarette that smelled of marijuana. Officer Westfall also located a small digital scale with a white crystal reside on the scale portion.
Dispatch also advised that Mr. Lee had an active arrest warrant. After being read his rights, Mr. Lee refused to comment.
Another back-seat passenger was searched by Officer Swinford and a glass smoking device with a white residue was located along with a bag that contained a white crystal-like substance. The name of this subject was redacted from the report due to the suspect being a minor.
The remaining suspects were searched with nothing illegal being found. The female driver was issued a citation for disregarding a stop sign.
The black folded up piece of paper in the green bag contained a white powdery substance that would test positive for cocaine and weighted approximately .1 gram. The plastic bag that contained the brownish/white powdery substance field tested positive for heroin and weighed approximately .8 grams. The smaller plastic bag containing the white crystal-like substance field tested positive for methamphetamine and weighed approximately 1 gram. The larger bag that contained the white crystal-like substance tested positive for methamphetamine and weighed approximately 14.7 grams. The bag located on the minor field tested positive for methamphetamine and weighted approximately .4 grams. The white residue on the digital scale would test positive for methamphetamine. Finally, the hand-rolled cigarette located on Mr. Lee tested positive for marijuana and weighed approximately .5 grams.
The juvenile suspect was released and will be seen by juvenile authorities at a later date.
James Lee, 39, of Pennville, IN was transported to the Miami County Jail to face charges of Obstruction of Justice, Possession of Marijuana, Possession of Heroin, Possession of Methamphetamine and Possession of Cocaine.
All criminal suspects are presumed innocent until proven guilty in a court of law.
